That the Aboriginal Areas Protection Authority:

  • be provided with a copy of any application to conduct hydraulic fracturing for onshore shale gas under petroleum environment legislation at an early stage of the assessment and approval process;
  • be given an adequate opportunity to explain the application to custodians; and
  • be given an adequate opportunity to comment on the application and have those comments considered by the decision-maker.

Implementation

Recommendation 11.2 requires the Aboriginal Areas Protection Authority (AAPA) to gain an understanding of and comment on the proposed Hydraulic Fracturing activities, consult custodians on the proposals and provide comments to the relevant decision maker.

This will take place in connection with environment management plans and environmental impact statements. AAPA and the Department of Environment, Parks and Water Security continue to monitor and work on processes with regular reviews to ensure appropriate outcomes are achieved.
